Mediation
In a family law scenario, should a party decide that divorce is inevitable and seeks to file for divorce, please give serious consideration to mediation as a method of resolving your marital differences. Almost every single divorce case filed in court is directed by a judge to mediation. Since you are going to be directed to mediation by the judge on your case, it is financially wiser to seek out a mediator yourself prior to entering the court system and filing for divorce.
Due to the complexity and variables of divorce law, once a case gets into the court system, no lawyer can guarantee you an outcome. Once parties retain the services of lawyers, their ability to empower themselves and exercise control of their fate is surrendered. That empowerment and control is further surrendered when a judge ultimately makes the decision regarding the following: (1) visitation with children, (2) relocation of children (if requested), division of marital property and other important matters regarding you and your family. When possible, do not subject yourself to a situation, whereby a judge is forced to decide on your behalf. I highly recommend that parties attempt to mediate their differences and arrive at a mutually beneficial (win-win) voluntary agreement.
Mediation is voluntary, confidential, less-stressful, quick, and inexpensive compared to court litigation. Ernesto Cespedes, Esq., is available as a mediator. Call now to schedule an appointment to discuss your case.
